>>>> Senate Bill 18 and House Bill 76: Health Occupations - Pharmacists - Administration of Vaccines

 


SB 18 and HB 76 are House and Senate versions of the same bill. As amended, they would allow pharmacists to vaccinate children:

- at age 3 and up for flu, Covid, and any vaccines used in response "a public health emergency," with NO dr's prescription required

- at age 7 and up for all other vaccines, with NO dr's prescription required

 

Maryland law prior to 2020 (and what it will revert back to if this bill does not pass) allowed phamacists to vaccinate children at age 9+ for flu and at age 11 for other vaccines WITH a dr's prescription. SB 18 and HB 76 are a radical departure from the previous policy!

 

HB 76 status: PASSED out of the HGO subcomittee, held for full committee vote on Tuesday March 12  (the bill was held due a request for further amendments by a member of the committee)       

SB 18 status: PASSSED out of Senate Finance committee, brought to Senate Floor for full vote on Friday March 8,  and held over for full Senate vote on Monday March 11 (the bill was held due to a request for amendment by member of the Senate)

OPPOSITION POINTS:


National media is exposing pharmacies as chaotic, dangerous places where staff are overworked and making mistakes. Pharmacists are overwhelmed already with adult vaccines, which now include Covid and RSV. They cannot handle the additional workload of childhood vaccines. - The best health outcomes for children occur when the parent and pediatrician work as a team and consider health history, precautions, and contraindications before making any medical decisions. Children are NOT vaccinated like adults and have a very complicated schedule, receiving multiple shots at once.


- Immunizations are pharmaceutical products that come with warnings, precautions, and contraindications. A child must be properly assessed prior to administration to reduce risk for serious harm and/or death. A pharmacist does not have this training or the time in their day.


- The Federal 1986 National Childhood Vaccine Injury Act removed liability for vaccine makers as well as from the provider that administers the vaccine. Pharmacists have not been trained in assessment for childhood vaccines and will not be liable for any mistakes, leaving children at risk.
